These Terms and Conditions outline the rules and regulations for the use of our services, including professional portrait photography, commercial photography, event photography, wedding photography, product photography, aerial drone photography, videography services, photo editing, video editing, and studio rental.

1. Definitions

• "Client," "You," "Your": Refers to you, the person accessing this website and accepting the Company’s terms and conditions.

• "Services": Refers to all photography, videography, editing, and studio rental services offered by Lens & Light Studios.
• "Content": Refers to all photographic, video, and other multimedia materials produced by Lens & Light Studios.

2. Service Engagement and Bookings

• 2.1 Booking Confirmation: All bookings for our services are subject to availability and confirmation. A booking is confirmed only upon receipt of a signed agreement or explicit written confirmation from Lens & Light Studios, along with any required deposit.
• 2.2 Deposits and Payments: A non-refundable deposit may be required to secure certain services. Full payment or the remaining balance is typically due on or before the service date, as specified in your individual service agreement. Payment terms will be clearly outlined in your quote or contract.
• 2.3 Cancellations and Rescheduling: Cancellation policies vary depending on the service and will be communicated at the time of booking. Generally, deposits are non-refundable. Rescheduling is subject to availability and may incur additional fees.
• 2.4 Client Responsibilities: The client is responsible for providing all necessary access, permissions, and accurate information required for Lens & Light Studios to deliver the services effectively. This includes, but is not limited to, ensuring venues are accessible, acquiring necessary permits, and ensuring subjects are present and prepared.

3. Intellectual Property and Usage Rights

• 3.1 Ownership of Content: Unless otherwise expressly agreed in writing, Lens & Light Studios retains all copyrights and ownership of all photographic and videographic content produced from our services.
• 3.2 Client Usage: Upon full payment for services, Lens & Light Studios grants the Client a non-exclusive, non-transferable license to use the Content for the purposes agreed upon in the service agreement. For personal photography (e.g., portraits, weddings), this typically includes personal use, sharing with friends and family, and social media posting. For commercial content, specific usage rights will be defined in the contract.
• 3.3 Company Usage: The Client grants Lens & Light Studios the right to use the Content for promotional purposes, including but not limited to, displaying on our website, social media, portfolios, and marketing materials, unless a specific non-disclosure or privacy agreement is in place.
• 3.4 Prohibited Use: The Client may not sell, license, or publish the Content for commercial purposes without explicit written consent from Lens & Light Studios. Altering the Content outside of agreed-upon editing is also prohibited.

4. Deliverables and Revisions

• 4.1 Delivery Times: Estimated delivery times for Content will be provided in your service agreement. These are estimates and may vary based on workload and complexity.
• 4.2 Editing and Retouching: All Content delivered by Lens & Light Studios will undergo our standard editing process unless a specific editing brief is provided and agreed upon. Additional revisions or extensive retouching beyond the agreed scope may incur extra charges.
• 4.3 Archiving: Lens & Light Studios retains original files for a specified period (typically 12 months) after project completion. After this period, files may be archived or deleted. Clients are advised to back up their delivered Content.

5. Limitation of Liability

• 5.1 Force Majeure: Lens & Light Studios shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, fire, flood, power outages, and adverse weather conditions.
• 5.2 Equipment Failure: While every reasonable precaution is taken, Lens & Light Studios is not liable for indirect or consequential damages arising from unforeseen circumstances or equipment malfunction. In the unlikely event of significant technical failure or loss of data, our liability is limited to the refund of monies paid for the specific affected service.
• 5.3 General Liability: Lens & Light Studios’ total liability for any claim arising from or related to our services shall not exceed the total amount paid by the Client for the specific services giving rise to the claim.

6. Privacy Policy

Your privacy is important to us. Any personal information you provide to Lens & Light Studios will be used solely for the purpose of communicating about and delivering our services, as outlined in our Privacy Policy, which is available on our website. We do not sell or share your personal data with third parties without your explicit consent, except as required by law.

7. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
